These Terms govern direct reservations, accommodation, optional services and use of the SkyGona website. Please read them carefully before submitting a booking request.

Telephone / WhatsApp: 599009989The business information stated in this Section forms an integral part of these Terms and identifies the trader responsible for providing direct accommodation services and processing personal data through the SkyGona website.In these Terms, “SkyGona”, “we”, “us” and “our” refer exclusively to the business identified above, unless a particular service is expressly stated to be provided by an independent third-party provider.
2. Scope, Acceptance and Language VersionsThese Terms apply to reservations made directly through:• the SkyGona website;
• email;
• telephone;
• WhatsApp;
• another direct communication channel operated by SkyGona.Reservations made through Booking.com, Airbnb or another third-party platform are also governed by the conditions displayed by that platform at the time of booking. Where the platform’s applicable conditions differ from these direct-booking Terms, the platform conditions shall govern that reservation.By confirming a direct reservation, making an advance payment or checking in, the lead guest confirms that:• they have read and understood these Terms;
• they accept these Terms on behalf of themselves and all accompanying guests;
• they have provided all accompanying guests with access to these Terms;
• the information supplied during the booking process is accurate.These Terms may be made available in English, Georgian and other languages.The language version presented to and accepted by the guest during the direct-booking process shall apply to that reservation. If a translation contains an obvious inconsistency or omission, the versions shall be interpreted together in good faith, taking into account the booking confirmation and the information actually provided to the guest.Nothing in a translated version limits any mandatory right or protection available under the laws of Georgia.3. Reservation Requests and ConfirmationSubmitting a form or sending a message does not automatically create a confirmed reservation.A direct reservation becomes confirmed only when:SkyGona confirms availability in writing;
the guest receives a written booking confirmation;
the guest accepts the stated price and conditions; and
any required advance payment is received by the stated deadline.The confirmation will identify:the selected chalet;
check-in and check-out dates;
number of guests;
total accommodation price;
payment schedule;
cancellation conditions;
any expressly included additional services.The guest must immediately report any incorrect information. SkyGona is not responsible for losses caused by information supplied incorrectly by the guest.4. Prices and Additional ChargesAll direct-booking prices are stated in Georgian lari unless expressly stated otherwise.The confirmed price may depend on:selected chalet;
dates and number of nights;
number of guests;
seasonal pricing;
promotions;
optional meals;
activities;
additional cleaning;
pet accommodation;
other services requested by the guest.Only services expressly listed in the booking confirmation are included.Prices displayed by Booking.com, Airbnb or another platform may differ because of platform promotions, commissions, discounts, exchange rates or service fees. SkyGona does not control independently applied platform pricing.Optional services must be paid for separately unless the confirmation expressly states that they are included.5. Direct Booking PaymentsUnless different conditions are expressly stated in the individual booking confirmation:• an advance payment of 30% of the total accommodation price is required to secure the reservation;
• the remaining balance must be paid no later than check-in;
• a reservation is not confirmed until the required advance payment has been received as cleared funds in the account or payment system designated by SkyGona.A payment instruction, bank receipt or screenshot showing that payment was initiated does not by itself confirm receipt of funds.Once the required amount has been received, SkyGona will provide written confirmation of the reservation.Payments may be accepted by bank transfer, payment link, cash or another method expressly confirmed by SkyGona.The guest is responsible for charges imposed by the guest’s bank, card issuer, currency-conversion provider or payment service.The guest must use the payment reference or booking information requested by SkyGona. SkyGona is not responsible for delays caused by incorrect payment details supplied by the guest.If payment is not received by the stated deadline, SkyGona may send written notice and release the dates if payment remains outstanding after the period specified in that notice.Any refund will be made, where reasonably possible, through the same payment method used for the original transaction.6. Cancellation by the GuestThe following policy applies to direct reservations unless different conditions are expressly stated in the individual booking confirmation.Cancellation at least 7 calendar days before check-inThe reservation may be cancelled without an accommodation cancellation charge.Amounts already paid will be refunded, less any non-refundable payment-processing or bank charges actually incurred by SkyGona.Cancellation fewer than 7 calendar days before check-inA cancellation charge equal to 50% of the total accommodation price applies.If the amount already paid exceeds the cancellation charge, the balance will be refunded.Cancellation on the check-in date or no-showA cancellation charge equal to 100% of the total accommodation price applies.Early departureIf the guest voluntarily leaves before the confirmed check-out date, unused nights are non-refundable unless:the early departure results from a material failure by SkyGona to provide the confirmed accommodation; or
applicable law requires otherwise.Cancellation requests must be submitted in writing by email or WhatsApp. A cancellation is effective when SkyGona confirms receipt.Approved refunds will normally be initiated within 10 business days. Additional processing time imposed by a bank or payment provider is outside SkyGona’s control.7. Date ChangesRequests to change reservation dates are subject to availability and must be confirmed in writing.A change may result in:a different nightly price;
an additional payment;
revised cancellation conditions;
loss of a previously applied promotion.Until SkyGona confirms the new dates, the original reservation remains valid.A request to change dates does not suspend an applicable cancellation deadline.8. Force Majeure and Cancellation or Modification by SkyGonaSkyGona may cancel, postpone, shorten or reasonably modify a reservation where accommodation cannot legally, safely or reasonably be provided because of an event outside SkyGona’s reasonable control.Such events may include, without limitation:• severe weather;
• heavy snowfall;
• avalanche, landslide, flood, earthquake or wildfire;
• blocked, damaged, closed or officially restricted roads;
• decisions, restrictions or orders issued by government, municipal, emergency or law-enforcement authorities;
• emergency evacuation;
• epidemic or public-health restrictions;
• fire or serious property damage;
• prolonged failure of essential infrastructure or utilities;
• interruption of transport or communications;
• civil disturbance, armed conflict or terrorism;
• another event that SkyGona could not reasonably prevent or overcome.SkyGona will notify the guest as soon as reasonably possible after becoming aware that the reservation is affected.Depending on availability and the circumstances, SkyGona will offer one or more of the following:• alternative dates;
• comparable available accommodation;
• a booking credit accepted by the guest;
• a refund of amounts paid for accommodation or services that SkyGona cannot provide.SkyGona will not charge the guest for accommodation that SkyGona cancels and does not provide.To the maximum extent permitted by law, SkyGona is not responsible for indirect expenses independently arranged by the guest, including flights, car hire, missed connections, lost working time or alternative travel arrangements, unless the loss was caused by conduct for which liability cannot lawfully be excluded.Nothing in this Section excludes or limits any mandatory right available to the guest under Georgian law.9. Check-in and Check-outCheck-in: from 14:00
Check-out: by 12:00Guests must provide an estimated arrival time in advance.Because SkyGona is located in a remote mountain area, arrival during daylight is strongly recommended.Early check-in or late check-out:requires prior written approval;
is subject to availability;
may incur an additional charge.An unauthorised late departure may result in a reasonable additional charge where it affects cleaning or the arrival of the next guest.10. Identity and Guest RegistrationThe person making the reservation must:be at least 18 years old;
have legal capacity to enter into the booking;
be authorised to act for all accompanying guests;
provide accurate contact and guest information.SkyGona may request identification where reasonably necessary for guest registration, security, invoicing or compliance with Georgian law.The lead guest is responsible for communicating these Terms to every accompanying guest.11. Occupancy and VisitorsOnly registered guests included in the confirmed reservation may stay overnight.The maximum occupancy of the selected chalet must not be exceeded.Unregistered visitors require prior approval from SkyGona.SkyGona may:refuse entry to undeclared guests;
charge the applicable additional guest fee;
require unauthorised visitors to leave;
terminate the stay for serious or repeated occupancy violations.Reservations may not be transferred, resold or sublet without written approval.12. Children and SupervisionChildren are welcome within the occupancy limit of the selected chalet.Parents and guardians remain fully responsible for supervising minors, particularly around:balconies and terraces;
stairs;
heating equipment;
outdoor fires;
slopes and mountain paths;
rivers and natural terrain;
animals;
outdoor activities.SkyGona does not provide childcare or continuous supervision.Children must not be left unattended where doing so creates a safety risk.13. House RulesGuests must respect the property, other guests, neighbouring residents and the natural environment.The following are prohibited:smoking or vaping inside the chalets;
parties or events without prior written approval;
excessive noise, particularly between 22:00 and 08:00;
illegal activity;
threatening, abusive or dangerous conduct;
unauthorised commercial photography or filming;
drone use without prior approval;
open fires outside designated areas;
removal or relocation of furniture or equipment without permission;
deliberate damage to plants, wildlife or the surrounding landscape;
disposal of waste outside designated containers.SkyGona may terminate a stay without refund where a serious violation creates danger, causes substantial disturbance, involves illegal activity or continues after a reasonable warning.Nothing in this section limits any mandatory rights the guest may have under Georgian law.14. Solar Power and Electrical AppliancesThe chalets operate on an off-grid solar power system. The available electrical capacity is limited and depends partly on weather and stored energy.To protect the system and prevent outages, guests must not use unauthorised high-wattage appliances, including:personal hair dryers;
clothing irons;
portable electric heaters;
electric cooking appliances not supplied by SkyGona;
other high-consumption electrical devices.Guests must use only appliances provided or expressly approved by SkyGona.Connecting an unauthorised appliance may overload the system and interrupt electricity supply.If a guest causes damage or a power failure through prohibited appliance use, SkyGona may charge the reasonable documented cost of repair or restoration.Temporary reductions in electrical capacity caused by weather or circumstances outside SkyGona’s reasonable control do not automatically entitle the guest to a full refund. SkyGona will nevertheless take reasonable steps to restore essential service.15. Mountain Location and AccessSkyGona is located in a remote mountain environment.Before booking, guests acknowledge that:roads may be narrow, uneven, steep, muddy, icy or temporarily inaccessible;
weather may change rapidly;
travel times may be longer than expected;
mobile signal and internet quality may vary;
emergency assistance may take longer to arrive than in an urban area;
natural terrain includes ordinary mountain risks.Guests must:follow the route and arrival instructions provided;
check weather and road conditions;
use a suitable vehicle where advised;
avoid travelling in unsafe conditions;
wear appropriate footwear and clothing.SkyGona may advise against travel or arrival when conditions are unsafe.A guest who disregards a clear safety warning assumes responsibility for the reasonably foreseeable consequences of that decision, except where the law provides otherwise.16. Internet, Water and UtilitiesSkyGona will take reasonable steps to provide the utilities and facilities described in the booking.However, due to the remote location, temporary interruption may occur because of:weather;
network failure;
maintenance;
infrastructure failure;
low solar production;
events outside SkyGona’s reasonable control.Internet access is provided as an amenity and is not guaranteed to be suitable for uninterrupted remote work, streaming or professional use.Guests must notify SkyGona promptly of a material problem and allow a reasonable opportunity to investigate and remedy it.17. PetsPets are allowed only with prior written approval.Before arrival, the guest must disclose:type of animal;
approximate size;
number of pets;
any relevant behavioural information.The guest is responsible for:continuous supervision;
cleaning after the animal;
preventing noise or disturbance;
preventing damage;
keeping the animal away from prohibited areas;
complying with applicable veterinary and safety requirements.A reasonable additional cleaning fee or refundable security deposit may be required and will be disclosed before confirmation.The guest is responsible for damage or exceptional cleaning caused by the animal.18. Property Damage, Loss and Exceptional CleaningGuests are responsible for damage, loss or exceptional cleaning caused by:the guest;
accompanying persons;
approved or unauthorised visitors;
pets.The guest must report accidental damage immediately.SkyGona may request reimbursement for reasonable documented costs arising from:damaged furniture or equipment;
missing items or keys;
smoking inside;
damaged or permanently stained textiles;
misuse of the solar system;
unauthorised parties;
excessive waste or cleaning;
damage to the building or surrounding property.Normal wear and tear is not chargeable.Where reasonably possible, SkyGona will provide photographs, receipts, invoices or a reasonable repair estimate.The guest will be given an opportunity to respond before a disputed charge is pursued, except where urgent action is required.19. Traditional Racha MealsTraditional Racha dishes and evening meals may be available by advance order.Unless expressly included in the booking confirmation:meals are charged separately;
orders must normally be placed at least 24 hours in advance;
availability depends on ingredients and local host availability;
menu options may vary seasonally;
cancellation conditions may apply after ingredients have been purchased or preparation has begun.Guests must disclose allergies, intolerances and dietary requirements before ordering.Reasonable care will be taken, but an entirely allergen-free preparation environment cannot be guaranteed.A guest with a severe allergy must contact SkyGona before ordering and must not rely solely on general menu descriptions.
20. Activities and ExperiencesHorse riding, hiking, guided trips, culinary experiences and other activities may be arranged upon request.Before confirmation, the guest will be informed whether the activity is:provided directly by SkyGona; or
supplied by an independent local guide or service provider.Activities are subject to:availability;
weather;
seasonal conditions;
minimum age or fitness requirements;
the provider’s safety rules;
separate pricing.Guests must provide truthful information about:age;
physical fitness;
riding or hiking experience;
medical restrictions relevant to participation;
any other factor reasonably affecting safety.The guide or provider may refuse, modify or stop participation where continuation would be unsafe.Guests must follow all safety instructions and use any required safety equipment.Nothing in these Terms excludes liability that cannot lawfully be excluded. Where an independent provider supplies an activity, that provider is responsible for its own performance, without limiting any mandatory rights the guest may have against SkyGona.
21. Personal Belongings and Lost PropertyGuests are responsible for securing personal belongings.SkyGona is not responsible for loss, theft or damage unless caused by SkyGona’s unlawful conduct, negligence or another circumstance for which liability cannot legally be excluded.Lost items found after departure may be retained for 30 calendar days.The guest is responsible for packaging, postage, courier and related delivery costs.Perishable, unsafe or low-value items may be disposed of earlier where storage is unreasonable.22. Photography, Filming and DronesPersonal photography and video are permitted provided they do not:disturb other guests;
invade another person’s privacy;
create a safety risk;
damage the property or environment.Commercial shoots, promotional productions, professional events and drone use require prior written approval.Additional location fees, insurance or safety requirements may apply.SkyGona will not use an identifiable guest’s image for advertising without permission or another valid legal basis.23. Behaviour and Termination of StaySkyGona may require a guest or visitor to leave where the person:presents an immediate safety threat;
commits or credibly threatens violence;
seriously damages property;
engages in illegal activity;
repeatedly disturbs others;
materially violates these Terms after being warned;
provides fraudulent booking information.Where reasonably possible, SkyGona will first explain the violation and provide an opportunity to correct it.A guest required to leave because of a serious contractual violation is not entitled to a refund for unused nights, subject to mandatory Georgian law.SkyGona may seek reimbursement for documented losses caused by the violation.

manage payments, cancellations and refunds;
provide requested meals and activities;
communicate before, during and after the stay;
meet accounting, tax and legal obligations;
ensure property and guest security;
prevent fraud or misuse;
establish, exercise or defend legal claims;
send marketing only where permitted.Depending on the circumstances, processing is based on:steps requested before entering into a contract;
performance of the booking contract;
compliance with a legal obligation;
SkyGona’s legitimate interests, balanced against the individual’s rights;
consent where consent is legally required.Georgia’s current personal-data law grants rights of access and other controls over personal information, with specified response periods.27. Sharing of Personal DataPersonal data may be shared where reasonably necessary with:Booking.com, Airbnb or another booking platform;
banks and payment providers;
accountants;
legal or professional advisers;
website, hosting, email and communications providers;
guides, meal providers or activity operators requested by the guest;
public authorities where disclosure is required by law;
emergency services where necessary to protect life or safety.SkyGona does not sell personal data.Recipients receive only the information reasonably necessary for their role.28. International Data TransfersSome external providers, including international booking, hosting, communications, map, analytics or social-media services, may process data outside Georgia.Where required, SkyGona will rely on a legally recognised transfer mechanism or other safeguard applicable under Georgian law.A person may contact SkyGona for available information about relevant recipients and safeguards.29. Data RetentionPersonal data will be retained only for as long as reasonably necessary for the relevant purpose.In general:unanswered enquiries may be retained for up to 12 months;
booking and transaction records may be retained for the period required by tax, accounting and limitation laws;
routine guest communications may be retained for up to 3 years after the stay where reasonably necessary;
complaint or dispute records may be retained until the matter and applicable legal limitation periods are concluded;
marketing data will be retained until consent is withdrawn or the information is no longer required.Data may be deleted, anonymised or securely archived when no longer needed.30. Data Subject RightsSubject to applicable Georgian law, a person may request:confirmation that their data is being processed;

MarketingReservation-related communication is not marketing and may be sent where necessary to manage an enquiry or booking.Promotional communication will be sent only where legally permitted.Marketing consent must be:separate from acceptance of these Terms;
optional;
specific;
capable of being withdrawn.A recipient may unsubscribe by using an available unsubscribe method or contacting SkyGona.Withdrawal of marketing consent does not affect essential booking communication.32. Website Cookies and External LinksThe website may use essential technical cookies needed for security and functionality.It may also link to or integrate external services, including:Google Maps;
Booking.com;
Airbnb;
WhatsApp;
Instagram;
Facebook;
TikTok;
payment services.External providers operate under their own terms and privacy policies.SkyGona does not control independent processing performed by those providers.Non-essential analytics or advertising technologies should not be activated without any consent required by applicable law.33. SecuritySkyGona uses reasonable organisational and technical measures intended to protect personal data against:unauthorised access;
accidental loss;
unlawful disclosure;
alteration;
destruction.No online or electronic system can be guaranteed completely secure.Guests must not send payment-card passwords, PIN codes or other unnecessary confidential credentials by email or WhatsApp.34. Complaints and Reporting ProblemsGuests must notify SkyGona of any material problem without undue delay after discovering it.Where reasonably possible, a problem relating to the accommodation should be reported during the stay and before check-out so that SkyGona has a fair opportunity to inspect the issue and provide an appropriate remedy.A guest should not arrange non-urgent third-party repairs or services at SkyGona’s expense without prior written approval.A complaint should include, where available:• the guest’s full name;
• the reservation number;
• the chalet and relevant dates;
• a clear description of the problem;
• when the problem was discovered;
• photographs, videos, receipts or other supporting information;

• investigate the issue fairly;
• provide a substantive response within 10 business days where reasonably possible.If more time is reasonably required because the matter is complex or involves an independent provider, SkyGona will inform the guest.Failure to report a problem during the stay may be taken into account where the delay prevented SkyGona from investigating or remedying the issue. However, this does not remove any mandatory consumer right or legal remedy available to the guest.Nothing in these Terms prevents a guest from contacting a competent consumer-protection, personal-data, regulatory or judicial authority.35. Limitation of LiabilityTo the maximum extent permitted by Georgian law, SkyGona is not responsible for:losses not reasonably foreseeable when the contract was concluded;
indirect or consequential commercial loss;
loss caused solely by inaccurate information supplied by the guest;
loss caused by a guest’s serious violation of safety instructions;
disruption caused exclusively by an event outside SkyGona’s reasonable control;
independent services not provided by SkyGona, except where applicable law provides otherwise.Nothing in these Terms excludes or limits liability for:intentional misconduct;
gross negligence where it cannot lawfully be limited;
death or personal injury caused by conduct for which liability cannot lawfully be excluded;
fraud;
breach of mandatory consumer rights;
any other liability that Georgian law does not permit to be excluded.The guest must take reasonable steps to minimise avoidable loss.36. Severability and InterpretationIf any provision is found invalid or unenforceable, the remaining provisions remain effective.The invalid provision will be interpreted or replaced only to the minimum extent necessary to make it lawful while preserving its intended commercial purpose where possible.Ambiguous standard terms will not be interpreted to remove mandatory consumer rights.Headings are included for convenience and do not limit the meaning of a provision.37. Governing Law and DisputesThese Terms and direct reservations are governed by the laws of Georgia.The parties will first attempt to resolve disputes through good-faith written communication.If the matter cannot be resolved, either party may apply to the competent authority or court under Georgian law.Nothing in this clause deprives a consumer of any mandatory jurisdictional or procedural protection available by law.
38. Intellectual PropertyUnless otherwise stated, the SkyGona name, logo, website design, written content, photographs, videos, graphics, branding elements and other original materials displayed on the SkyGona website are owned by SkyGona or used with the permission of their respective rights holders.Website content may be viewed and shared for personal, non-commercial purposes only.Without prior written permission, no person may:• copy, reproduce, republish or commercially distribute website content;
• use SkyGona photographs or videos in advertisements, listings or promotional materials;
• create a misleading association with SkyGona;
• register or use a business name, domain name, social-media account or advertising keyword that impersonates or is confusingly similar to SkyGona;
• alter, remove or conceal a copyright, ownership or attribution notice;
• scrape, systematically extract or create a commercial database from website content.Guests retain ownership of photographs and other content they independently create.SkyGona will not use identifiable guest-created content for commercial promotion without permission or another lawful basis.A guest who voluntarily tags, mentions or sends content to SkyGona does not automatically transfer ownership of that content.Third-party trademarks, platform names and logos, including Booking.com, Airbnb, Google Maps and social-media brands, remain the property of their respective owners.Nothing in these Terms grants a licence to use SkyGona’s intellectual property except for the limited personal use expressly permitted above.
39. Changes to These TermsSkyGona may update these Terms to reflect changes in its services, operational procedures or legal obligations.The current version will be published on the website together with the “Last updated” date.Unless mandatory law requires otherwise, the version presented to and accepted by the guest when the reservation was confirmed shall apply to that reservation.SkyGona will not retroactively impose a materially less favourable condition on an already confirmed reservation without the guest’s express agreement.
